Following conditions have to be
fulfilled for a valid marriage;
i.
Offer/Proposal
on the part of one party to the other party to the marriage.
ii.
Acceptance
by the other party to the marriage.
iii.
Presence
of witnesses ;
·
According
to Hanafi law, at least two adult male or
one adult male and adult two female witnesses are required for a valid marriage.
·
According
to Shia law, no witnesses are required.
iv.
The
offer and acceptance both must be expressed in one and same meeting.
v.
The
Nikha
Nama must be registered one.
A valid marriage creates a lot of
rights for both husband and wife. Some of them are as follows;
a.
Sexual
intercourse between husband and wife becomes lawful,
b.
The
children born of the union are legitimate,
c.
The
wife becomes entitle to get her dower,
d.
The
wife becomes entitle to get her maintenance,
e.
The
wife is bound to maintain the order of her husband,
f.
The
husband becomes entitle to restrain the wife’s movement in a reasonable manner,
g.
Mutual
rights of inheritance are established,
h.
Without
observing iddat, the wife is not entitled
to remarry, if she has gotten divorce.
