Yes! A widow can file suit against
the legal heirs of the husband, if they do not acknowledge to give dower to
their mother. The wife of the deceased is totally entitled to go to court for
exercise her legal right. Moreover, the wife is also entitled to get
inheritance from her deceased husband. The wife is also entitled to get legal
help from the court of law, if the heirs of her deceased husband refuse to give
her portion of property from her husbands’ property. The heirs of the deceased
persons are legally bound to pay the amount of dower of the deceased’s wife
(widow), otherwise the widow can claim her dower through the court of law. But
the amount of dower should be deferred dower, prompt dower can be claimed through
the court of law. A widow may file a suit for prompt dower before the court of
law, but the suit will not take effect within the jurisdiction of the court of
law.
